I am a guest of the Mountain Lake Inn, hereby agree that me and my guests am entering the premises known as The Mountain Lake Inn, Osceola’s Landing LLC, Todd Leoni, or any other affiliated properties located in Hendersonville, North Carolina (the “premises”) at MY SOLE RISK. I agree that I will not hold the Owner of the premises, its partners, tenants, or agents (and any persons employed by or affiliated with any of them), responsible or liable in any way for any injury, death, damage, injury or loss which I might suffer while on the premises or surroundings, the lake or creek regardless of whether or not my injury or loss is caused by any act, omission or negligence of any of the aforementioned parties or persons.

 

I further agree, that I understand, that WE MUST HAVE A LIFE JACKET ON THE CANOE, PADDLEBOARD as suggested in the guest handbook while on any watercraft in or on the lake. ALL CHILDREN 16 AND UNDER MUST WEAR LIFE JACKETS while on any watercraft or on the lake and will hold owner harmless for any liability or demands that may arise in connection with the presence or upon the premises.

 

I agree to indemnify and hold the Owner of the premises, its partners, tenants, agents and all officers, directors, employees, agents and persons affiliated with the foregoing entities harmless from and against any and all liabilities, losses, damages, costs and expenses (including attorney’s fees), suit claims and judgements of whatsoever kind and nature arising from, out of, or in connection with any injury to, or death of any person or any damage to any property resulting from or in any way relating to my entry upon the premises or the use of boats, equipment or supplies, loaned to me by or any person affiliated with the premises, or the Owner. In the event that my activities require the use of any equipment or boats which are the property of the aforementioned parties or persons, I WILL USE THE EQUIPMENT AT MY OWN RISK and assume any and all responsibilities for the use of such equipment

RETURN ALL PADDLES AND LIFE VESTS AFTER USE.
